DTS Technical Support Services – Acceptable Use Policy for Email Services

I. Introduction and Purpose

This Acceptable Use Policy (“AUP” or “Policy”) governs the use of all email-related services, including email hosting provided as part of our service packages (“Email Services”), offered by DTS Technical Support Services (d.b.a. “DTS TSS,” “we,” “us,” or “our”). This Policy is an integral part of your service agreement with DTS TSS and is designed to ensure the integrity, security, and reliability of our network, comply with applicable laws, and protect our clients and the broader internet community from illegal, malicious, or irresponsible behavior.

By using our Email Services, you (“Client,” “you,” or “your”) agree to be bound by the terms outlined in this Policy. Adherence to this AUP is a mandatory condition for the continued use of DTS TSS Email Services.

II. General Conduct and Prohibited Use

Your use of our Email Services must be legal, ethical, and respectful of the rights of others. You are solely responsible for the content you create, send, and receive. The following activities are strictly prohibited:

  • Illegal Activities: Transmitting, distributing, or storing any material in violation of any applicable law or regulation. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.  
  • Harassment and Abuse: Sending email that is harassing, abusive, threatening, or libelous. This includes sending messages with offensive or discriminatory remarks regarding race, religion, gender, sexual orientation, age, or disability.  
  • Malicious Content: Knowingly sending or forwarding emails containing malicious software, such as viruses, worms, or trojans, or linking to such content.  
  • Fraudulent Activity: Engaging in any activity intended to defraud others, including phishing, impersonation, or creating a false identity to mislead recipients.  
  • System and Network Disruption: Interfering with the proper functioning of any network, system, or service. This includes mail bombing, flooding, or other deliberate attempts to overload a system.  

III. Zero-Tolerance Anti-Spam Policy

DTS TSS maintains a strict, zero-tolerance policy against the transmission of unsolicited commercial email, commonly known as “Spam.” The use of our Email Services for spamming is a material breach of your service agreement and will be dealt with severely.

A. Definition of Spam Spam is defined as any unsolicited email sent to a recipient without their prior, verifiable consent. This includes, but is not limited to, bulk commercial advertising, promotional materials, and informational announcements.

B. Legal Compliance All email communications sent through our services must comply with the federal Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM Act) and Florida’s Electronic Mail Communications Act. Key requirements include, but are not limited to:  

  • Accurate and non-misleading header information (“From,” “To,” “Reply-To”).
  • Subject lines that accurately reflect the content of the message.
  • A clear and conspicuous identification that the message is an advertisement or solicitation.
  • A valid physical postal address of the sender.
  • A clear and functional opt-out mechanism that is honored promptly.  

C. Prohibited Spam-Related Activities You may not use our Email Services to:

  1. Send any form of Spam.
  2. Purchase or use third-party mailing lists unless you can provide proof that recipients explicitly consented to receive emails from you.
  3. Conceal the origin of any email by using false, forged, or misleading headers.  
  4. Harvest email addresses from websites or other sources without consent.  
  5. Operate an open mail relay or proxy.

IV. Enforcement and Penalties for Spam Violations

DTS TSS actively monitors its network for abuse. Any client found to be in violation of Section III of this Policy will be subject to the following strict enforcement protocol.

A. Investigation All reports of spam or other email abuse are thoroughly investigated by our dedicated Abuse Team. We reserve the right to use all available information to determine if a violation has occurred.

B. First Confirmed Violation: Written Warning Upon the first confirmed instance of a spam violation, the following actions will be taken:

  1. You will be issued one (1) written warning via email, detailing the violation.
  2. You will have one (1) hour from the time the warning is sent to respond to our Abuse Team and provide confirmation that the issue has been fully resolved.
  3. *Failure to respond and resolve the issue within the one-hour timeframe will result in the immediate restriction of your account.* Your email services will be suspended until you contact us to address the violation.

C. Second Confirmed Violation: Permanent Termination and Ban After one written warning has been issued, a second confirmed spam report will result in the following immediate and irreversible actions:

  1. Permanent termination of your account and all associated services with DTS TSS.
  2. Permanent deletion of all data associated with your account.
  3. You will be permanently banned from purchasing or using any future services from DTS TSS.

D. No Refunds Violations of this AUP, particularly the Anti-Spam Policy, will result in the forfeiture of all fees paid for the services. No refunds will be issued for accounts terminated due to policy violations.

V. Cooperation with Law Enforcement

DTS TSS is committed to upholding the law. We will cooperate fully with all local, state, and federal law enforcement and regulatory agencies upon receipt of a valid legal request (such as a subpoena or court order) in the investigation of any suspected criminal or civil wrongdoing. This cooperation may include the disclosure of your account information, IP addresses, and email records. Furthermore, we reserve the right to proactively refer any activity we believe to be illegal to the appropriate authorities, including violations of anti-spam statutes.  

VI. Disclaimer Regarding Third-Party Carriers and Services

Our Email Services may be used in conjunction with services provided by third-party carriers, such as your Internet Service Provider (ISP) or other network providers. This section serves as a critical disclaimer regarding the scope of our policy.

When you engage with a third-party carrier or provider, you are fully bound by the terms and conditions, acceptable use policies, and email policies set by that particular carrier. Nothing in this DTS TSS Policy shall stand for or against the policies of a carrier or provider that you choose to do business with. We have no control over, and assume no responsibility for, the policies or practices of any third-party service. It is your sole responsibility to be aware of and comply with the terms of all providers whose services you utilize.  

VII. Policy Modifications

DTS TSS reserves the right to modify this Acceptable Use Policy at any time without prior notice. Any changes will be effective immediately upon posting the revised policy on our website. Your continued use of our Email Services after any such changes constitutes your acceptance of the new Policy.
